1. Acceptance of Terms
By downloading, installing, or using Illumity ("the App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.
2. Description of Service
Illumi is an AI-powered image generation application that allows users to create images from text prompts. The service operates on a credit-based system where users purchase credits through in-app purchases and spend credits to generate images.
3. Account Registration
You must create an account using Google Sign-In or Apple Sign-In to use the App. You are responsible for maintaining the security of your account and for all activities that occur under it. You must provide accurate information and promptly update it if it changes.
4. Credits & Purchases
Credits are purchased through in-app purchases processed by Apple. Each image generation consumes a specified number of credits. Credits are non-transferable and have no cash value. All purchases are final and non-refundable, except as required by applicable law or Apple’s refund policies. We reserve the right to modify credit pricing and consumption rates with reasonable notice.
5. Acceptable Use
You agree not to use Illumi to: generate images that are illegal, harmful, threatening, abusive, harassing, defamatory, or otherwise objectionable; create content that infringes on any third party’s intellectual property, privacy, or other rights; produce content depicting minors in inappropriate contexts; generate deepfakes or misleading imagery intended to deceive others; attempt to circumvent content safety filters or usage limits; reverse-engineer, decompile, or disassemble any part of the App; or use the service for any unlawful purpose.
We reserve the right to suspend or terminate accounts that violate these guidelines, without refund of unused credits.
6. AI-Generated Content
6.1 Ownership
Subject to these Terms, you retain rights to the images you generate using Illumi, to the extent permitted by applicable law. You acknowledge that AI-generated content may have limitations regarding copyright protection in certain jurisdictions.
6.2 No Guarantees
AI-generated images are produced by third-party machine learning models. We do not guarantee that generated content will be accurate, appropriate, free from bias, or suitable for any particular purpose. Results may vary and are not always predictable.
6.3 Content Moderation
We may implement content filters and moderation measures to prevent the generation of prohibited content. We reserve the right to review, remove, or refuse to generate content that violates these Terms.
7. Intellectual Property
The App, including its design, code, features, and branding, is the property of Illumi and is protected by intellectual property laws. These Terms do not grant you any rights to our trademarks, logos, or other proprietary content beyond what is necessary to use the App.
8. Disclaimer of Warranties
THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS.
9. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE APP, INCLUDING BUT NOT LIMITED TO LOSS OF DATA, REVENUE, OR PROFITS.
10. Indemnification
You agree to indemnify and hold harmless Illumi and its affiliates from any claims, damages, losses, or expenses (including reasonable legal fees) arising from your use of the App, your violation of these Terms, or your infringement of any third-party rights.
11. Termination
We may suspend or terminate your access to the App at any time for violation of these Terms or for any other reason at our discretion. You may stop using the App at any time. Upon termination, your right to use the App ceases immediately, and any unused credits may be forfeited.
12. Changes to Terms
We may modify these Terms at any time. We will notify you of material changes through the App or other appropriate means. Continued use of the App after changes take effect constitutes your acceptance of the revised Terms.
